Bank levies generally occur in cases in which the State is a party and you typically have to have a threshold amount of arrears for this type of action to occur against your assets. If the Division of Child Support Services is involved in your case, and you owe child support arrears, there are many administrative remedies available to them, not just bank levies. All of the administrative options can occur against any asset that you are associated with so it is possible that your future spouse’s bank account could be subject to levy. There are options for “injured spouses” to make a claim that the money seized was theirs and not an asset of the delinquent spouse however, which would allow her to recover all funds that were her earnings.
