Types of Drug Crimes

We have successfully defended clients against a wide range of drug charges, including:

  • Illegal possession of marijuana: Anything over two pounds (the statutory threshold) is treated as possession with intent to sell. Possession of less than two pounds of marijuana is a class six felony with a minimum prison sentence of six months.
  • Possession of dangerous drugs: The state classifies many drugs other than marijuana as dangerous, including methamphetamine, LSD, hallucinogenic mushrooms, mescaline, clonazepam, PCP, and other drugs. It is a crime to knowingly possess, use, sell, or intend to sell dangerous drugs. Possession of methamphetamine, amphetamine, LSD, or PCP is a class four felony carrying a minimum prison sentence of one and a half years.
  • Narcotic drug crimes: It is unlawful in Arizona to possess, use, sell, manufacture, transport, administer to another person, or fraudulently obtain narcotic drugs, including heroin, morphine, cocaine, opium, and oxycodone. Offenders may also face federal charges. Conviction of possession or possession with intent to sell could bring severe penalties, including heavy fines and years in prison.
  • Prescription drug crimes: Arizona is cracking down on prescription drug crimes. It is illegal to possess or use prescription drugs in this state, except as directed with a valid prescription in your own name from a licensed doctor. It is also illegal to sell, administer, transport, or manufacture prescription drugs, or possess the chemicals and equipment to make them, without proper authorization. Illegal prescription drug possession can lead to a six-month prison sentence, or worse.
  • Drug paraphernalia: It is unlawful in Arizona to possess illegal drug paraphernalia – the tools and special equipment used to consume them. This includes paraphernalia associated with marijuana, dangerous drugs, narcotics, and peyote. Drug paraphernalia is confiscated by law enforcement officers upon arrest. Possession, sale, advertising, promotion, or delivery of illegal drug paraphernalia is a class six felony, punishable by up to one and a half years in prison.
