Mesa Municipal Court and Maricopa Superior Court
Occasionally, a client worries about the court with jurisdiction over the case. This is especially so with criminal charges. Put your fears aside. Divorce and family law cases are only filed in Arizona’s Superior Court. Whatever the legal matter at hand, civil or criminal, we are very familiar with all of the courthouses in Maricopa County because our six main office locations are here and in Phoenix and surrounding communities.
In addition to lawsuits heard in the Maricopa Superior Court and appeals in the Arizona Court of Appeals, each of our attorneys has logged ample hours advocating for clients in the Mesa Municipal Court system.
The Mesa Municipal Court has jurisdiction over certain matters arising within the city limits, such as traffic offenses. The same client could have a case pending in Mesa Municipal Court, another case pending in Superior Court, and another small claims case pending in Justice Court (in rural areas). We carry-out our professional responsibilities in every courthouse, before every judge assigned, and never skip a beat.
More specific to our attorneys’ routine family law, criminal defense, and estate planning practice, the Mesa Municipal Court may issue an order of protection, injunction against harassment, or workplace injunction. Each order could arise in a case where we represent a party and there is the potential for domestic violence, stalking, or other safety concerns. (Police can arrest a defendant for violating a protective order.)
In general, the Mesa Municipal Court has limited jurisdiction over misdemeanor criminal cases, but only when the alleged incident arose within the city limits. These misdemeanor offenses include:
- Reckless driving;
- Disorderly conduct;
- Theft and shoplifting; and
- Leaving an accident scene, among others.
When the charge is a felony (for example, felony DUI with a child under the age of 14 in the vehicle), the case must be heard in the Superior Court of Maricopa County, not Mesa’s city court.
