The mother is divorced from the father of the child. He has not been in the child’s life for most of her life. The mother and I have been living with each other since 2010 but are not married. Can I move forward w/o being married with stepchild adoption?
The short answer is no. On rare occasion, the court will terminate the other parents rights without them being remarried but generally for a step-parent adoption the parties must be married for at least one year. You can motion the court to waive the one year requirement, especially in a case where they have lived together as husband and wife for a number of years.
