Does the portion of child support paid when one child emancipates automatically go toward the arrears if you do not modify ??
No. Arizona does not have “per child” support orders. If a support order had multiple children on the order, the child support amount stays the same until the last child on the order emancipates, at which point the duty to pay current child support ends. So long as there remains at least one child on the order, the original amount due remains unchanged until you go back to court to get the order modified. If you have a Title IV-D case involving the State, when the youngest child emancipates, what was the current support amount will become the arrears payment amount automatically. This however does not happen in cases where the State is not involved. In those cases a Petition must be filed to request an increase in the arrears payment.
