I have been paying spousal support for 20yrs. I am 64yrs old, on social security, have health issues and a part time job that pays minimum wage. I rent a small home and with the other expense can not afford the required spousal support of $680.00 a month. I need free advice. My ex is in the process of fling papers to bring me back to court, for being behind in payment from last Oct 2015. She has her own business and owns a home in Scottsdale valued at $350,000 plus. I need help to live a reasonable life. Please respond
This question is most easily answered by reviewing the court order for spousal support. Typically, spousal support is for a specific duration and then terminates upon that time period. On occasion, the order is for indefinite, which means when the receiving spouse is financially self-sufficient the order may terminate put the paying spouse needs to petition the court for same. On rare occasions the support will be lifetime, which might mean it cannot be terminate or reduced. These issues can all be answered during a consultation by reviewing the original divorce decree.
