I have three children with my live in girlfriend, I am listed as parent on birth certificates. I own a home with girlfriend also. I want 50/50 custody of my three children and I want our property to be sold and my name off of deed of home. This does not involve divorce as we were never married. I and my girlfriend are gainfully employed and want to dissolve assets with girlfriend. Is this a long expensive process as in a divorce?
If you have never formally established legal paternity you will need to file a Petition to Establish so that you are legally the father. You will also establish legal decision making, parenting time and child support. Because you were not married, the court will not have jurisdiction over your assets and those can be resolved in civil court if necessary but hopefully the two of you can agree on a proper disposition. Shared custody is certainly possible when you have two involved parents but the facts of any specific case are always important and should be discussed with a lawyer. Generally, this process takes 4 to 8 months depending on how agreeable the parents are and if trial is required to resolve any disputes.
